Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal.
  • Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with FLOWSTEAM.
  • Day: calendar day.
  • Continuous performance contract: a distance contract relating to a series of products and/or services, where the delivery and/or purchase obligation is spread over time.
  • Durable data carrier: any means that enables the consumer to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information.
  • Right of withdrawal: the possibility for the consumer to waive the distance contract within the cooling-off period.
  • FLOWSTEAM: the natural or legal person who offers products and/or services remotely to consumers, located at Sloepkade 1, 2725EX, Zoetermeer, Netherlands, Chamber of Commerce number 94884730, VAT number NL866924280B01.
  • Distance contract: a contract whereby, within the framework of a system organised by FLOWSTEAM for the remote sale of products and/or services, up to and including the conclusion of the contract, only one or more means of remote communication are used.
  • Means of remote communication: means that can be used for concluding a contract without the consumer and entrepreneur being simultaneously present in the same room.

Article 3 - Applicability

  • These general terms and conditions apply to every offer from FLOWSTEAM and to every distance contract concluded between FLOWSTEAM and the consumer.
  • Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
  • If the distance contract is concluded electronically, the text of these general terms and conditions may be made available to the consumer electronically in such a way that it can be easily stored by the consumer on a durable data carrier.

Article 4 - The offer

  • If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
  • The offer contains a complete and accurate description of the products and/or services offered, including clothes steamers.
  • Obvious mistakes or errors in the offer do not bind FLOWSTEAM, and FLOWSTEAM is therefore not obliged to deliver these items.
  • Every offer contains such information that it is clear to the consumer what the rights and obligations are that are attached to accepting the offer.

Article 5 - The agreement

  • The agreement is concluded at the moment of acceptance by the consumer of the offer and the fulfilment of the conditions set out therein.
  • If the consumer has accepted the offer electronically, FLOWSTEAM will immediately confirm receipt of the acceptance of the offer electronically.
  • FLOWSTEAM always has the right to refuse or cancel an order within 14 days of the order.

Article 6 - Right of withdrawal

  • Customers have the right to withdraw their purchase within 30 days, in accordance with Article 6:230o of the Dutch Civil Code (BW).
  • This cooling-off period starts on the day after all products have been received by the consumer.
  • The right of withdrawal does not apply to custom-made products.

Article 7 - Costs in case of withdrawal

  • If the consumer wishes to exercise their right of withdrawal, FLOWSTEAM offers a free return service for all customers in the Netherlands and Belgium. This means you do not have to pay shipping costs for returning your product.

Article 8 - Exclusion of right of withdrawal

  • FLOWSTEAM may exclude the consumer's right of withdrawal for products made at the consumer's request or that are clearly personal in nature.

Article 9 - The price

  • During the validity period stated in the offer, the prices of the offered products and/or services will not be increased, except for price changes due to changes in VAT rates.
  • All prices are fixed prices.

Article 10 - Payment terms

  • Payments must be made immediately, unless the consumer chooses Klarna, in which case payment at a later date is possible.
  • Payment methods: iDEAL, Klarna, credit/debit card.
  • There are no penalties for late payment by FLOWSTEAM. However, Klarna may charge interest or fees according to its terms and conditions.

Article 11 - Delivery conditions

  • Delivery of services/products: Physical product.
  • Delivery time: Orders in the Netherlands and Belgium placed before 22:00 on a working day will be delivered the next day. Orders placed during the weekend will be delivered on Tuesday.
  • Shipping costs: Free shipping on all orders in the Netherlands and Belgium.
  • Transfer of risk: The risk transfers to the customer upon delivery of the product, in accordance with Article 7:11 of the Dutch Civil Code (BW).

Article 12 - Liability and warranties

  • Liability: The consumer is responsible for the correct use of the clothes steamers according to the supplied user manual. Using the clothes steamers in a manner contrary to the user manual may result in damage, and FLOWSTEAM cannot be held liable for this.
  • Warranty: The warranty on the products is 2 years and is valid for the original purchaser from the date of first purchase. Proof of purchase is required to obtain support under the warranty. This warranty does not cover:
    • negligent use or misuse of the product;
    • use with incorrect voltage or current;
    • fall damage;
    • water damage;
    • use contrary to the operating instructions;
    • disassembly, repair or modification by anyone other than FLOWSTEAM;
    • damage caused by accidents or disasters, such as fire, flood, earthquake, war, vandalism or theft;
    • damage due to improper maintenance and storage;
    • damage caused by incorrect connections;
    • accessories such as batteries;
    • exposure to adverse external influences, such as sunlight and other radiation or electromagnetic fields;
    • normal wear and tear.

Article 13 - Complaints procedure

  • Complaints can be submitted via the contact form on the website or by email. We aim to respond to complaints within 14 days, in accordance with Article 6:2 BW.

Article 14 - Applicable law and competent court

  • Applicable law: Dutch law applies to these terms and conditions, in accordance with Article 3:40 BW.
  • Competent court: Disputes will be submitted to the competent court in the district where FLOWSTEAM is established, unless another competent court in the Netherlands is legally mandatory.

Article 15 - Privacy Policy and data protection

  • Collection of personal data: Personal data is collected and processed via Shopify. For more information, please refer to Shopify's privacy policy.
  • Use of cookies: Our website uses cookies to improve the user experience. Necessary cookies are automatically placed, and for non-essential cookies, we do not ask for consent, in accordance with the ePrivacy directive. Customers can adjust their cookie settings via their browser.
  • Intellectual property: All content on the website, including but not limited to text, images, logos, and software, is the property of FLOWSTEAM and is protected by intellectual property rights, in accordance with the Copyright Act (BW, Book 3).
  • Force majeure: In case of force majeure, such as natural disasters, strikes, or other unforeseen circumstances, FLOWSTEAM is not liable for non-fulfilment of obligations, in accordance with Article 6:75 BW.
